Terms of Service

1. What RefaceX is

RefaceX ("we," "us," "the Service") lets a registered user ("you") transform their own live camera feed in real time using an AI video model, for the purpose of live streaming and content creation. The Service is billed per second of use ("pay as you stream"); credits are purchased in advance and consumed as you use the Studio.

2. Eligibility

• You must be at least 18 years old to create an account and use RefaceX. The Service is not directed at, and must not be used by, anyone under 18.
• You must provide accurate account information and are responsible for all activity under your account and for keeping your login credentials secure.
• You may not use the Service if you are barred from doing so under the laws of your country or ours.

3. Your content and consent for likenesses

When you use the Studio, you upload your own live camera feed and, optionally, reference images or text prompts describing the character or appearance you want to become.

• You may only transform your own likeness. RefaceX is built for you to appear as someone or something else on your own stream — not to superimpose or fabricate another real, identifiable person's likeness without that person's explicit, informed consent.
• Reference images of real people require consent. If a reference image depicts a real, identifiable person other than you, you confirm you have that person's permission to use their image this way, or that the image is of a fictional/animated character, a stock/licensed asset you have rights to use, or otherwise not a real private individual.
• You retain ownership of content you upload. By uploading it, you grant RefaceX a limited license to process it solely to provide the transformation and streaming output you requested. See our Privacy Policy for how long this content is retained.
• You are solely responsible for the content you generate and stream, including compliance with any platform (Twitch, TikTok, YouTube, etc.) you stream it to.

4. Prohibited uses

This section is not exhaustive. RefaceX may suspend or terminate any account engaged in conduct it reasonably believes violates the spirit of these restrictions, even if not listed explicitly below. Full detail is in our Acceptable Use Policy, which is part of these Terms. In summary, you must not use RefaceX to:

• Generate, request, or attempt to generate any content that sexualizes, exploits, or endangers a minor, in any form. This is an absolute, zero-tolerance prohibition; violations are reported to the National Agency for Prohibition of Trafficking in Persons (NAPTIP), the National Centre for Missing & Exploited Children (NCMEC), and/or relevant law enforcement, and result in immediate, permanent termination without refund.
• Impersonate a real person — public figure or private individual — without their consent, in a way intended to deceive, defraud, harass, defame, or damage their reputation.
• Create non-consensual intimate or sexually explicit imagery of any real person.
• Run or facilitate scams, fraud, romance/investment schemes, phishing, fake giveaways, impersonation of businesses or officials, or any activity designed to deceive viewers into giving up money or personal information.
• Produce political disinformation, synthetic "news," or election-related content designed to mislead viewers about who is speaking or what was said.
• Harass, threaten, bully, or incite violence against any person or group.
• Infringe another party's copyright, trademark, or other intellectual property rights (for example, recreating a copyrighted character you have no rights to use commercially).
• Violate any applicable law, including Nigeria's Cybercrimes (Prohibition, Prevention, etc.) Act and equivalent laws in any jurisdiction you operate from or target.

5. Payments, credits, and no refunds

Full detail is in our Refund Policy, which is part of these Terms. In summary:

• RefaceX is a pay-as-you-use service billed per second of streaming. Credits are purchased upfront via Paystack or Flutterwave and consumed as you stream.
• All credit purchases are final and non-refundable once completed, except where required by law or to correct a genuine billing error (e.g. a duplicate charge).
• Credits do not expire, but they are non-transferable between accounts and have no cash value.
• If your account is suspended or terminated for violating these Terms or the Acceptable Use Policy, any remaining credit balance is forfeited and will not be refunded.
• Initiating a chargeback or payment dispute without first contacting support may result in immediate account suspension.

6. AI-generated output — no guarantee

RefaceX's output is generated by a third-party AI model and is provided "as is." We do not guarantee any specific level of visual accuracy, realism, latency, or uptime. AI models can behave unpredictably; RefaceX is not liable for the specific content the model generates in response to your input, though you remain responsible for what you choose to stream or publish.

7. Moderation and enforcement

We may, at our discretion and without prior notice, monitor usage patterns (not the private content of your streams by default, but as needed to investigate reports or suspected abuse), suspend or terminate accounts, withhold credit balances forfeited under Section 5, and report unlawful activity — including content involving minors, credible threats of violence, or fraud — to appropriate authorities.

8. Intellectual property

The RefaceX name, logo, and platform (excluding your own uploaded content and the underlying third-party AI model) belong to RefaceX. You may not copy, resell, or white-label the Service without our written permission.

9. Limitation of liability

To the maximum extent permitted by law, RefaceX and its owners/operators are not liable for indirect, incidental, or consequential damages arising from your use of the Service, including reputational harm from content you or others generate, third-party platform actions taken against your stream, or service interruptions. Our total liability for any claim is limited to the amount you paid RefaceX in the 3 months preceding the claim.

10. Indemnification

You agree to indemnify and hold RefaceX harmless from claims, damages, and expenses (including legal fees) arising from your misuse of the Service, content you upload or generate, or your violation of these Terms, the Acceptable Use Policy, or any law.

11. Changes to these Terms

We may update these Terms from time to time. Continued use of RefaceX after an update constitutes acceptance of the revised Terms.

12. Governing law

These Terms are governed by the laws of the Federal Republic of Nigeria, without regard to conflict-of-law principles, unless otherwise required by mandatory law in your jurisdiction.
